Administrative, Procurement Code, from April 18 mandatory the Single European Competition Document (DGUE) in electronic format

The novelty introduced pursuant to art. 85, paragraph 1, of the Code of public contracts

For tender procedures announced as of 18 April, the contracting stations will prepare and accept the DGUE in electronic format according to the provisions of the Prime Ministerial Decree of 13 November 2014

Starting on 18 April, the Single European Competition Document (DGUE) will have to be made available exclusively in electronic form, in compliance with the provisions of the Public Procurement Code (Article 85, paragraph 1).

For tender procedures announced as of 18 April, the contracting stations will prepare and accept the DGUE in electronic format according to the provisions of the Prime Ministerial Decree of 13 November 2014.

The tender documents should contain information on the specific electronic format of the DGUE, the address of the website where the service is available for compiling the DGUE and the ways in which the electronic DGUE must be transmitted by the economic operator to the station contracting.

Until October 18, 2018 – date of entry into force of the obligation of electronic communications pursuant to art. 40, paragraph 2, of the Code of public contracts – the contracting authorities that do not have their own management service of the DGUE in electronic format, or that do not use other IT management systems of the DGUE, will request in the tender documents to economic operator to transmit the document in electronic format, compiled in the manner indicated therein, on an IT support within the administrative envelope or via the electronic trading platform used for the submission of tenders.

From 18 October, the DGUE will have to be prepared exclusively in accordance with the technical rules that will be issued by AgID pursuant to art. 58 paragraph 10 of the Code of public contracts.

For all tender procedures announced as of October 18, any DGUE of formats other than the one defined by the aforementioned technical rules will be considered as supporting illustrative documentation.

The integrity, authenticity and non-repudiation requirements of the electronic DGUE must be guaranteed in accordance with the provisions of the Digital Administration Code referred to in the Legislative Decree of 7 March 2005, no. 82.
